Release, Waiver of Liability, and Indemnity Agreement
In consideration of being permitted to participate in Art on Main and to maintain a booth or activity therein, on Saturday, June 8th, 2024, the Undersigned, for it, its representatives, heirs, successors, and assigns:
1) HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE THE ART ON MAIN organization, Main Street Ravenna, Inc., their representatives, heirs, successors, and assigns (hereinafter referred to as Indemnitees) from any claims or demands due to any loss or damage on account of any injury to person or property caused by the negligence of Indemnitee while the Undersigned is participating in Art on Main in any manner.
2) HEREBY AGREES TO INDEMNIFY, SAVE AND HOLD HARMLESS THE INDEMNITEES from any claims or demands due to any loss or damage on account of any injury to person or property caused by the negligence of the Undersigned or its agents while the Undersigned is participating in, setting up, working, observing or otherwise in Art on Main.
3) HEREBY ASSUMES FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE due to the negligence of the Indemnitees or otherwise while participating in Art on Main and while setting up the booths, working, observing, or otherwise participating in such event.
4) I UNDERSTAND THAT: Main Street Ravenna has the right and responsibility to cancel the Art on Main event due any pandemic cases in accordance with State of Ohio mandates and will notify all applicants in a timely manner regarding the cancellation up to 2 weeks in advance of the event at the latest.
Each of the Undersigned further expressly agrees that the foregoing Release, Waiver of Liability, and Indemnity Agreement is intended to be as broad and inclusive as is permitted by the law of the State of Ohio and that the balance shall, notwithstanding, continue in full force and effect. THE UNDERSIGNED HAS READ AND VOLUNTARILY SIGNS THE RELEASE, WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT, and further agrees that no oral representation, statements, or inducements apart from the foregoing written agreement have been made.
